What Happens if You Don't Register Your Baby with the Civil Registry on Time? Almost No One Knows
The deadline is no longer 24 hours — and almost no one knows it. There are 4 procedures with critical deadlines after a baby's birth. If you miss any, you could lose money, delay your benefits, or complicate your life.
You've just had a baby. The excitement, the tiredness, the sweet chaos of the first few days... and suddenly someone tells you: "Hey, have you done the paperwork yet?"
Many families come to us with the same scare: "They told us the deadline was 24 hours and three days have already passed." Don't worry. The Civil Registry deadline is no longer 24 hours — it was extended to 8 business days. But there are other equally important procedures with real consequences if not managed correctly.
The 4 Procedures with Critical Deadlines After Birth
Civil Registry Registration
The legal basis for your baby's identity. Without it, you cannot complete any other procedures.
Maternity and Paternity Leave (INSS)
The sooner you submit it, the sooner payment begins. An error can delay payment by weeks.
Baby's Registration with Social Security
For health coverage from day one. It is not automatic: you must apply for it.
Application for aid and benefits
Each aid has its own deadline. Some families leave more than €1,000 unclaimed.
Civil Registry Registration: What You Need and How to Do It
What documentation do you need?
- Medical birth report (provided at the hospital)
- Valid DNI or passport of both parents
- Declaration of birth form
Where and how is it done?
From the Hospital
Many centers have an agreement to start the registration before you go home.
Civil Registry or Justice of the Peace
At the Civil Registry of the municipality where the baby was born. Request an appointment.
We recommend preparing all documentation before week 36-37 of pregnancy. If the baby has already been born, you can also hire us and we will guide you immediately.
Maternity and Paternity Leave: Deadlines and What No One Tells You
Both parents are entitled to 19 weeks of birth leave at 100% of the regulatory base.
| Leave | Duration | Mandatory weeks | Can it be split? |
|---|---|---|---|
| Maternity leave | 19 weeks | 6 weeks at birth | Yes |
| Paternity leave | 19 weeks | 6 weeks at birth | Yes |
| Multiple birth extension | +2 weeks/baby | Case-dependent | By agreement |
Baby's Social Security Registration: Why It's Not Automatic
You must apply for it specifically. Without doing so, the baby has no health coverage or health card.
- Before the TGSS, online with a digital certificate or Cl@ve, or in person at any CAISS
- You will need the baby's civil registration and the affiliated parent's social security number
If you want us to do it for you, hire our newborn social security registration service.
You can apply for it once registered. In our Premium Pack and Pro Pack, we manage it along with the parent's.

Frequently Asked Questions
What is the deadline to register the baby with the Civil Registry?+
8 business days from birth. Previously it was 24 hours, but the Civil Registry Law extended this period. If exceeded, the registration becomes "overdue" and may require additional documentation.
Is the baby's health coverage automatic at birth?+
No. Registration with Social Security is not automatic. You must apply for it with the TGSS. Until then, the baby has no coverage or health card. You can delegate it to us: newborn registration.
How many weeks of leave do mothers and fathers have in 2026?+
Both parents have 19 weeks at 100% of the regulatory base. The first 6 are mandatory and immediate. The remaining 13 can be split into two periods.
How does the working mother benefit work?+
It is not automatic. Choose between a €1,200/year deduction on your income tax for 3 years, or a €100/month payment for 3 years. At Babybelegal, we manage this benefit from the Essential Pack.
Can I do all the procedures online?+
In most cases, yes, with a digital certificate or Cl@ve. At Babybelegal, we do all procedures 100% online throughout Spain, without you having to travel.
Conclusion: Time is Running, But You're Not Alone
