👨👧 Be registered or in a similar situation to being registered with Social Security.
🧾 Accredit a minimum contribution period, according to the father's age:
Under 21 years old: no minimum contribution.
Between 21 and 26 years old: at least 90 days contributed in the previous 7 years or 180 in total.
Over 26 years old: at least 180 days in the previous 7 years or 360 in total.
🏠 Reside legally in Spain and be registered.
📄 Submit the necessary documentation, including ID/NIE, company certificate, and information about the birth or adoption.
⏱️ Request the leave from the date of birth or adoption, within the deadlines established by Social Security

Frequently asked questions about applying for paternity leave
Paternity leave lasts for 19 weeks and is non-transferable, meaning it cannot be assigned to the mother or another parent.
Yes, after the first 6 mandatory weeks, the remaining 11 weeks can be taken intermittently in different periods within the baby's first year. And the other 2 weeks remaining until your child is 8 years old.
If you choose staggered leave, each additional period must be processed as a new procedure and will incur an additional cost.
Self-employed workers also have the right to paternity leave, provided they meet the following requirements:
✔Be registered with the Special Regime for Self-Employed Workers (RETA).
✔Be up to date with Social Security payments.
No, paternity leave is incompatible with any work activity.
Leave can begin at the following times:
✔Immediately after the birth of the baby.
✔From the adoption or fostering resolution date.
You will be paid 100% of the regulatory base of your salary, gross.
If the father is collecting unemployment benefits, the benefits must be temporarily suspended during paternity leave. Once the leave ends, unemployment benefits can be resumed.
