Maternity leave for single-parent families: 32 weeks at 100%

What is the birth benefit for single-parent families?

The birth and childcare benefit is the financial aid that covers 100% of your salary while you are on leave after your baby's birth. What many single-parent families don't know is that they are entitled to 32 weeks, double that of families with two parents.

The logic is clear: in a two-parent family, both parents have 19 weeks each (it used to be 16), which totals 38 weeks of care between the two. Since there is only one parent in a single-parent family, the law compensates for this difference with additional weeks.

How the 32 weeks are distributed: the full calendar

The 32 weeks are not necessarily taken all at once. There is a fixed part and a part that you can organize according to your situation and your work.

6 mandatory and immediate weeks

The first 6 weeks after childbirth are mandatory, full-time, and must be taken immediately. They cannot be postponed or split. This is the mandatory rest period by law.

22 flexible weeks during the first year

The following 22 weeks can be enjoyed flexibly in weekly periods (continuous or interrupted) until the baby turns 12 months. You can take them consecutively or intersperse them with part-time work.

4 additional weeks up to 8 years of age

The last 4 weeks (double the 2 for two-parent families) can be enjoyed flexibly until the child turns 8 years old. These are the "parental leave" weeks from Royal Decree-Law 9/2025.

Can you take part of the leave before childbirth? Yes. The biological mother can anticipate up to 4 weeks of leave before the probable due date, provided she notifies the company 10 days in advance. This reduces the weeks available after childbirth.

Requirements to be entitled to the 32 weeks

To access the birth benefit as a single-parent family, you must meet the general requirements for the benefit plus recognition of your single-parent status.

General benefit requirements

  • Be affiliated with and registered with Social Security at the time of birth (or equivalent)
  • Have contributed a minimum of 180 days in the last 7 years, or 360 days throughout your working life
  • If you are under 21 years old: no minimum contribution period is required
  • If you are between 21 and 26 years old: minimum 90 days contributed in the last 7 years

Specific single-parent family requirements

  • Be the sole parent with effective parental responsibility over the minor
  • The other parent does not exist (anonymous donor, single mother by choice) or does not exercise parental authority
  • In practice, the INSS requests documentation to prove the single-parent situation
  • Shared custody, in general, does not grant entitlement to the 32 weeks of single-parent family leave

How to apply for single-parent maternity leave step-by-step

The application is made to the INSS, just like any family's leave. The difference lies in the documentation you need to provide to prove your single-parent status.

Valid DNI or NIE. Social Security affiliation number. Bank details for benefit payment.

Birth certificate or updated family book. In case of adoption or foster care, the corresponding judicial or administrative resolution.

Notification to the company of the start date of the leave. In some cases, company certificate with contribution data.

Proof of single-parent status

Responsible declaration of single-parent status, and/or judicial resolution proving the absence of the other parent or the lack of exercise of parental authority.

Are you self-employed? You are also entitled to the 32 weeks

Self-employed workers (RETA) who are single-parent families have exactly the same rights as employed workers. In addition, during the leave period, a 100% bonus on the self-employment fee applies, meaning you don't pay a fee while on leave.

More aid you can combine with leave The birth benefit is compatible with other aid. If you are a working mother, you can also apply for the €100/month aid for working mothers for 3 years (or €1,200/year in your tax return). And don't forget to register your baby with Social Security, as it is not automatic.

What other aid can you apply for as a single-parent family?

The 32 weeks of leave is the best-known right, but not the only one. These are the main additional aids you can access:

Working mother's aid: €100/month or €1,200/year in tax return For mothers who work and contribute. Compatible with leave. You can choose to collect it monthly or as a deduction in your tax return.
One-time payment of €1,000 for birth for vulnerable families For single-parent families with low incomes. Processed by the INSS. Compatible with the birth benefit.
Minimum Living Income (IMV) and Child Support Complement (CAPI) If your income is low, the Minimum Living Income and its complement for minors can supplement your income. The condition of being a single-parent family improves access and the amount.
Specific regional aid for single-parent families Several autonomous communities have their own aid for single-parent families: from bonuses for nurseries to direct birth aid. It depends on where you live.
Baby's registration with Social Security This is not done automatically. It must be expressly requested so that your baby has medical coverage from day one.

It depends. Exclusive custody resulting from a separation or divorce does not automatically equate to single-parent family status for benefit purposes. What is relevant for the INSS is that the other parent does not exercise parental authority or does not exist.
